EASI Terms of Use

1.0 Acceptance of Terms
1.1 By creating an account, accessing, or using the EASI application (“App”), you agree to be bound by these Terms of Use (“Terms”).
1.2 The App is owned and operated by Cayman eFoil Ltd., a company registered in the Cayman Islands.
1.3 “EASI” (eFoil Accreditation & Safety International) is a trademark and platform name operated under Cayman eFoil Ltd.
1.4 If you do not agree to these Terms, you must not use the App.
1.5 By using the App, you represent that you are at least 18 years old (or the age of legal majority in your jurisdiction), or that you have the consent of a parent or legal guardian.

2.0 Nature of the Platform
2.1 EASI is a digital platform designed to:

(a) log riding sessions

(b) track rider progression

(c) manage equipment (“quiver”)

(d) connect riders, instructors, and operators

2.2 The App operates as a software platform and informational tool only.
2.3 The App does not provide real-world supervision, coaching, rescue services, or safety oversight.
2.4 No features of the App, including rider levels, instructor designations, or operator tiers, constitute professional advice or real-world supervision.
2.5 EASI does not currently constitute a separate legal entity and is operated under Cayman eFoil Ltd.
2.6 Any in-person training, supervision, charter, or rental services are provided solely by independent third-party operators or instructors, who are not employees, agents, or representatives of Cayman eFoil Ltd., unless expressly stated in a separate written agreement.
2.7 Use of the App does not create any partnership, joint venture, employment, or agency relationship between users and Cayman eFoil Ltd.

3.0 User Responsibility and Assumption of Risk
3.1 You are solely responsible for:

(a) your actions on the water

(b) your riding decisions and safety

(c) compliance with all applicable laws and regulations

(d) the accuracy of any information you submit

3.2 Motorized hydrofoil and similar watersports activities involve inherent risks, including serious injury or death.
3.3 You acknowledge and agree that you participate in such activities entirely at your own risk and assume full responsibility for all resulting risks.
3.4 You agree that you will not rely on the App for emergency, rescue, or safety-critical decision-making.
3.5 The App does not provide medical, emergency, or rescue services, and nothing within the App constitutes medical or professional safety advice.
3.6 You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

4.0 No Warranty
4.1 The App and all information provided through it are offered on an “as is” and “as available” basis.
4.2 Cayman eFoil Ltd. makes no representations or warranties of any kind, express or implied, including but not limited to:

(a) accuracy, completeness, or timeliness of session data

(b) rider levels or progression

(c) reliability of user-submitted information

(d) uninterrupted, secure, or error-free operation of the App

4.3 Cayman eFoil Ltd. does not guarantee that the App will be available at all times or that access will be uninterrupted.
4.4 To the fullest extent permitted by law, all such warranties are disclaimed.

5.0 Session Logging and Data Accuracy
5.1 Session data (including duration, conditions, location, equipment used, and performance metrics) is submitted by users and may be optionally verified by other users or platform processes.
5.2 Cayman eFoil Ltd. does not independently verify session data, rider history, or progression and is not responsible for inaccuracies, omissions, or misrepresentations.
5.3 You are responsible for ensuring that any data you submit is accurate and does not mislead others.

5.4 The App does not guarantee the accuracy of time tracking, calculations, or aggregated data derived from session logs. 

6.0 Instructor, Rider, and Operator Status
6.1 Instructor designations, rider levels, operator tiers, and verification statuses displayed in the App are based on platform data, internal standards, and processes that may evolve over time.
6.2 These designations may not reflect governmental licensing, insurance coverage, or legally recognized qualifications.
6.3 Users are solely responsible for independently evaluating any rider, instructor, or operator before engaging in real-world activities.
6.4 Any engagement with other users is undertaken at your own discretion and risk.
6.5 Cayman eFoil Ltd. does not guarantee the competence, qualifications, or safety practices of any user, instructor, or operator.

7.0 Equipment, Brands, and Product Information
7.1 The App may display equipment, products, and brand information, including eFoil boards, batteries, wings, and accessories.
7.2 All product names, logos, and brands are the property of their respective owners.
7.3 Cayman eFoil Ltd. and the EASI platform are not affiliated with, sponsored by, or endorsed by these brands unless explicitly stated.
7.4 Cayman eFoil Ltd. does not guarantee product performance, safety, suitability, or compatibility.
7.5 You are responsible for following all manufacturer instructions, warnings, and recommendations.

8.0 Messaging and User Conduct
8.1 The App may allow users to communicate and interact.
8.2 You agree not to:

(a) harass, abuse, or threaten others

(b) provide false, misleading, or defamatory information

(c) use the App for unlawful or harmful purposes

(d) interfere with or disrupt the App or its security

8.3 You are solely responsible for any content you transmit through the App.
8.4 Cayman eFoil Ltd. may, at its sole discretion, restrict, suspend, or terminate accounts and remove content at any time.

8.5 Cayman eFoil Ltd. is not responsible for monitoring or moderating all user communications and does not guarantee the accuracy, integrity, or legality of user-generated content. 

9.0 Limitation of Liability
9.1 To the maximum extent permitted by law, Cayman eFoil Ltd. and its directors, officers, employees, agents, and affiliates shall not be liable for any:

(a) personal injury or death

(b) property or equipment damage

(c) loss or corruption of data

(d) indirect, incidental, consequential, special, or punitive damages

9.2 This limitation applies to any losses arising out of or in connection with:

(a) your use of or inability to use the App

(b) your reliance on any information within the App

(c) your participation in any related activities

9.3 This applies whether based in contract, tort, negligence, strict liability, or otherwise, even if advised of the possibility of such damages.
9.4 Your sole and exclusive remedy for dissatisfaction with the App is to stop using it.

10.0 Indemnification
10.1 You agree to indemnify, defend, and hold harmless Cayman eFoil Ltd., its directors, officers, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or related to:

(a) your use of the App

(b) your violation of these Terms

(c) your participation in any related activities

11.0 Account Termination and Changes to the App
11.1 Cayman eFoil Ltd. reserves the right to:

(a) suspend or terminate accounts

(b) remove or modify content

(c) restrict or modify access to the App

11.2 These actions may be taken at any time, with or without notice.
11.3 You may stop using the App at any time.
11.4 Certain data may be retained as required by law or for legitimate business purposes.

12.0 Changes to Terms
12.1 These Terms may be updated from time to time.
12.2 You may be required to accept updated Terms to continue using the App.
12.3 Continued use of the App after changes take effect constitutes acceptance of the updated Terms.

13.0 Privacy and Data Use
13.1 Your use of the App is also subject to our Privacy Policy, which describes how we collect, use, and protect your data.
13.2 By using the App, you consent to these practices and agree to review the Privacy Policy from time to time for updates.

14.0 Entire Agreement
14.1 These Terms constitute the entire agreement between you and Cayman eFoil Ltd. regarding use of the App and supersede any prior agreements or understandings relating to the App.

15.0 Governing Law and Jurisdiction
15.1 These Terms shall be governed by and interpreted in accordance with the laws of the Cayman Islands.
15.2 The courts of the Cayman Islands shall have exclusive jurisdiction over any disputes arising from these Terms, subject to any mandatory local consumer protection laws that may apply.
